UpVal is intended for use by adults who are authorised staff or administrators of a school or educational organisation. By using UpVal, you represent that you are at least 18 years of age and are authorised by your organisation to use the platform on its behalf. UpVal is not intended for direct use by students or minors.
UpVal is currently in a developmental phase. You should not use UpVal in high stakes, sensitive, or operational school environments without contacting us first and arranging a bespoke arrangement.
UpVal is made available on an “as is” basis, and may contain errors, bugs, or other functionality that should not be relied upon for important or sensitive tasks. As an awards and recognition management platform, any award records, data exports, or reports produced by UpVal should be verified by your organisation before being relied upon for official purposes.
Some content on the Platform, including award descriptions and narrative reports, is generated by AI language models. AI-generated content may contain errors or omissions. It is provided as a drafting aid only and must be reviewed by qualified staff before being used for any official, administrative, or student-facing purpose. We make no warranty that AI-generated content is accurate, complete, or appropriate for any particular use.
If you would like to deploy UpVal in a live school environment, or for high stakes or sensitive use, please contact us to arrange a bespoke arrangement to ensure we can meet your requirements.
While we make all reasonable efforts to ensure that award data, records, and associated information are reproduced accurately, we provide no assurance, warranty or guarantee that content is accurate, complete, or reliable.
You must not use UpVal for any unlawful purpose or in a way that violates these terms. In particular, you must not:
We reserve the right to suspend or terminate access for any user or organisation that violates these terms.
You and your organisation retain ownership of all data you upload or create through the Platform, including student records, recognition data, and award information. We do not claim ownership of your data. On written request, we will provide a machine-readable export of your organisation’s data. Upon account termination, our handling of your data is governed by the Privacy Policy.
UpVal, including its software, design, and associated content, is owned by EdUP Solutions Pty Ltd and is protected by applicable intellectual property laws. Nothing in these terms grants you any right to use our trade marks, logos, or branding without our prior written consent.
Updates may be made to UpVal at any time. For significant changes that materially affect functionality or data access, we will make reasonable efforts to provide advance notice. We cannot guarantee continuous availability of any particular feature.
We may update these terms from time to time. If we make significant or material changes, we will provide reasonable notice by email or through the Platform. Continued use of UpVal after the notice period constitutes acceptance of the updated terms.
To the maximum extent permitted by applicable law:
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable Australian consumer protection law.
You agree to indemnify, defend, and hold harmless EdUP Solutions Pty Ltd and its directors, employees, and contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising from: (a) your use of UpVal in breach of these terms; (b) your organisation’s data or content uploaded to the Platform; or (c) your violation of any applicable law or third-party rights.
Your use of UpVal is also governed by our Privacy Policy, which forms part of these terms. By using UpVal, you agree to the collection and use of information in accordance with that policy.
These terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or related to these terms or your use of UpVal. Before commencing legal proceedings, the parties agree to attempt to resolve any dispute by good-faith negotiation for at least 30 days.
